1. Terms and conditions of purchases on mama-tierra.org
1.1. These terms and conditions (TAC) apply to sales contracts with retail customers, through this site (www.mama-tierra.org). These conditions are based on Swiss law. For contracts with companies please request the respective corporate terms and conditions document. Without the consent of the TAC, there cannot be any sales.
1.2. If the order is completed for example by phone, email or in writing, these conditions shall also apply. Customers will be notified in the confirmation order where they can download the terms and conditions on the web. If a customer in certain cases does not agree with these conditions, he or she can take his or her right of rescission claim, see paragraph 5.3.
2. Prices and Sales
2.1. The prices are quoted in CHF. Included in the total costs are VAT and Non-European customs fees. Processing fees for returns and shipping costs are billed separately.
2.2 Mama Tierra flat rates are charged for deliveries. Mama Tierra is not liable for any additional charges that may result from the delivery process, for example, customs/duty taxes.
2.3 Mama Tierra reserves the right to change prices according to the current season. For the customer are the date published prices on mama-tierra.com compulsory.
2.4 The conditions for promotions and discounts are available on www.mama-tierra.org next to the respective product offerings.
3. Order and Delivery
3.1 The delivery will take place after the payment of the buyer. Normally, the order is shipped as soon as possible, arriving within 5 working days in Switzerland, 15 days in Europe and 30 days outside Europe. The buyer is informed with a confirmation email about his order. If a longer delivery time needed, the customer will be notified as soon as possible. The delivery is made by the Swiss Post.
3.2 Deliveres over 55 CHF are free of charge only within Switzerland.
4. Notice of defects and returns
4.1.We are a charity project. Each return is for us a challenge. The customer can cancel the order within 7 days if the products are damaged. If the customer dislikes the product, he or she may pay the shipping costs and 20 CHF administration costs. He or she may exchange the ordered product within 30 days against another product on mama-tierra.org. The deadline for exercise of this right shall begin on the date on which the goods arrive at the consumer. The returned merchandise must be in perfect conditions to be resold, which means to be like it was sent by Mama Tierra (including etiquettes and flyers).
4.2 If a customer cancels the purchase due to late delivery, defects in the goods or should the Mama Tierra team be responsible, the supplier shall return already paid amounts, but not delivery and return shipping costs, if the customer reports the incident within seven days. After 7 days, the usual delivery fees are applied. If the delivery to the buyer experiences logistical problems due to third parties, for what Mama Tierra is not responsible, this is not accredited as right of withdrawal or rescission.
Products might be a 10% different as in the product picture. Since the items are handmade, variations are likely to happen. The latter is not considered a defect.
4.3 Vouchers are not refundable and expire after one year. Vouchers can be redeemed in the webshop or in the Mama Tierra Atelier, not at trade fairs or pop-ups. Vouchers cannot be exchanged for cash in part or full.
4.4 Products in sales cannot be canceled nor returned.
5.1. Mama Tierra guarantees for a period of 12 months, that the product has the guaranteed properties, their suitability for the intended use and the required performance and truth of the displayed specifications. Differences in the product photos and sizes could be influenced by the web view.
5.2 The Buyer shall review the goods delivered as quickly as possible and report defects immediately (within 7 days). The competent customer service can be found at www.mama-tierra.org
The payment is possible at the request in the following ways:
- The bill will be sent before shipment of the goods by email. Subsequently received payment, the ordered goods will be shipped.
- The customer can use their Swiss post card or any credit card by using Paypal. We accept all major credit cards.
The price of the goods is recorded on the date on which the goods will be dispatched.
7. Liability for online purchases
7.1. Mama Tierra is committed to the maintenance of their systems and programs that provide security and update them in accordance with current technical standards and to follow the rules of data protection. The customer data entered on mama-tierra.com will not be disclosed to third parties but used for internal marketing.
7.2 Our clients have to ensure the security of systems, programs and data that reside in their power. Customers should not disclose in their own interest passwords and usernames to third parties. It is advised to keep them confidential.
7.3 The provider is not liable for defects and malfunctions, which she was not responsible, especially not for security lapses and breakdowns of third-party companies with whom he works or from whom she depends.
7.4 Further Mama Tierra is not liable for improper action and disregard for the risks of customer and third parties, excessive use, unsuitable equipment of the customer or third party, extreme environmental conditions, interference by the customer or interference by third parties (viruses, worms, etc.).
8. Jurisdiction, applicable law and place of performance.
The local court of Baden (Switzerland) shall be responsible for judgment of disputes arising in conjunction with this Agreement to which Swiss law shall apply. The jurisdiction is in Baden in Canton Aargau, the seat of Mama Tierra.
