Terms and Conditions
1. Terms and conditions of purchases on mama-tierra.org
1.1. These General Terms and Conditions (GTC) apply to purchase contracts with private customers concluded via the website mama-tierra.org. These conditions are based on Swiss law. For contracts with companies, the “GTC Purchase Contract with Corporate Customers” apply, which can be obtained upon request. No sale can take place without agreement with the GTC.
1.2. For sales contracts concluded by other means, e.g. by telephone, e-mail, letter or on site in the Mama-Tierra studio and at sales fairs, these GTC also apply. Customers will be informed in the order confirmation where they can download the GTC on the Internet.
2. Prices and Sales
2.1. Prices are quoted in CHF. Handling fees for returns and shipping costs are charged extra.
2.2 Mama Tierra charges flat rates for shipping. Mama Tierra is not liable for any additional charges that may arise from shipping, such as customs/duty taxes.
2.3 Mama Tierra reserves the right to adjust prices seasonally. Customers are subject to the prices published on mama-tierra.org on the order date.
2.4 Terms and conditions for promotions and discounts are available on www.mama-tierra.org at the respective product offer.
3. Delivery conditions
3.1 Delivery is made after payment by the buyer. As a rule, the order will be shipped as soon as possible and should arrive within 5 working days in Switzerland, 15 days in Europe and 30 days outside Europe. The buyer will be informed about their order with a confirmation email. If a longer delivery time is required, the customer will be notified as soon as possible. The delivery will be made by Swiss Post or UPS.
4. Right of withdrawal and rescission
4.1. We are a charity project. For us each return is a challenge, therefore only exchanges are accepted and no refunds are made unless the product is damaged. In this case, the damage should be reported within 7 days after receipt. If the customer dislikes the product, he or she may pay the shipping costs plus 20 CHF administration fee to exchange it within 30 days against another product on mama-tierra.org. The deadline for exercise of this right shall begin on the date on which the goods arrive at the customer. Please contact info@mama-tierra.org before returning the goods, otherwise the goods will not be accepted. The returned merchandise must be in perfect conditions to be resold, which means to be like it was sent by Mama Tierra (including tags and flyers).
4.2 If a customer withdraws from the purchase because the goods are defective, Mama Tierra will refund amounts already paid if the customer reports the defect within 7 days by email: info@mama-tierra.org. Shipping costs, return shipping costs or customs fees will not be refunded. The defects must be described in detail. Small variations in the sample are not considered defects, as it is handmade and each product is unique. The products/samples are 90% similar. Returns will not be accepted after the 7-day defect notification period mentioned above. If the delivery does not reach the buyer within the period mentioned in point 3.1 due to logistic or other problems for which Mama Tierra is not at fault, this shall not be considered a reason for cancellation.
4.3 Vouchers expire after one year. Vouchers can only be redeemed in the web shop or in the Mama Tierra Atelier, not at trade fairs or pop-ups. Vouchers cannot be exchanged for cash, neither in part nor in full.
4.4 Products that are not in stock will be delivered in 2-8 weeks. Cancellations will not be accepted in this case. Customer will be contacted via e-mail to be notified about the exact waiting period.
4.5 Products on clearance cannot be returned. All sales are final.
5. Liability and Warranty
5.1. Mama Tierra warrants for a period of 12 months that the goods will have the warranted characteristics, will be free from defects that would impair their value or fitting for the intended use, and will conform to the prescribed specifications and requirements. Differences in product photos and sizes could be affected by web viewing. If you are not sure whether the product meets your needs and expectations, please contact us by e-mail at: info@mama-tierra.org. We will be happy to send you more product photos and/or videos.
6. Payment
The payment of the goods and shipping costs is possible in the following ways:
– The invoice will be sent by e-mail before the goods are shipped and can be paid immediately by PayPal, credit or debit card, e-banking or at the post office. The price of the goods will be posted on the day the goods are shipped.
– After receiving the payment, a payment confirmation will be sent and then the goods will be shipped. The shipment tracking number can be found online in the customer account at mama-tierra.org for the corresponding order.
7. Liability for online purchases
7.1. Mama Tierra is committed to provide security in accordance with the current state of technology in systems, programs, etc., belonging to the organization and over which it has control, and to follow the rules of data protection. Customer data entered on mama-tierra.org will not be disclosed to third parties.
7.2 Our customers have to take care of the security of the systems, programs and data that are in their sphere of influence. In their own interest, customers should keep passwords and user names secret from third parties.
7.3 Mama Tierra shall not be liable for any defects or failures that are beyond its control, including but not limited to security defects and operational failures of third-party companies with which it works or on which it depends.
7.4 Furthermore, Mama Tierra is not liable for force majeure, improper actions and disregard of risks on the part of the customer or third parties, excessive use, unsuitable equipment of the customer or third parties, extreme environmental influences, interference by the customer or interference by third parties (viruses, phishing, etc.) that occur despite the necessary current security measures.
8. Application of law and place of jurisdiction.
Swiss law shall apply. The place of jurisdiction is Baden in the canton of Aargau, the head office of Mama Tierra.
